The Federal Supreme Court revokes Article 5 of the dissolved Revolution Command Council Decision No. 39 of 1994

The Federal Supreme Court considered the appeal submitted by the Internal Security Forces Court, which requested a statement of the constitutionality of the amended dissolved Revolution Command Council decision No.(39) of 1994.

The court found that Article (5) of decision no.( 39) of 1994, which states (Those accused of crimes stipulated in Paragraph 1 of this decision shall be referred to the Special Court at the Ministry of Interior by a decision of the competent investigating judge), its contradicts the text of Article (95) of the Constitution, which prevent the establishment of special or exceptional courts.

The statement concluded that the Court decided that Article 5 of decision  No. (39) of 1994 that was amended for contradicting the text of Article 95 of the Constitution of the Republic of Iraq for the year 2005.
