Federal Supreme Court overturns procedural decision to Presidency of Council of Representatives

    The Federal Supreme Court confirmed that the duration of the objection to the membership of the Members of the Council of Representatives is open and not limited to a time limit and extends throughout the parliamentary session while overturning a procedural decision of the Presidency of the Council in this regard because the presidency of the Council specified it thirty days from repeating the oath contrary to the provisions of article 52/ 1st of the Constitution.

 

"The Federal Supreme Court has heard the claims of (8) candidates to overturn the decision of the Presidency of the Council of Representatives to reject their objection to the authenticity of the membership of other deputies," said Judge Abdul Sattar Berkdar, spokesman for the Federal Judiciary.

"The Council of Representatives decided to reject the requests of candidates objecting to the authenticity of the membership of some of its members on April 30, arguing that these requests were made 30 days after the alternative representative repeats the oath," Berkdar said.

 

"The court, after scrutiny and deliberation, overturned this decision," he said, adding that "it found that the 30-days period is binding on the presidency of the Council of Representatives to submit the objection to the Council of Representatives to decide it by a two-thirds majority following Article 52 of the Constitution."

 

"The Federal Court held that the objector had the right to file his objection even on the last day of the parliamentary session in the event of a flaw in the authenticity of the membership of a member of parliament," he said.
