
Master's thesis discusses the role of the Federal Supreme Court in preserving national sovereignty
The College of Law at the University of Baghdad discussed a master's thesis entitled (The Role of the Federal Supreme Court in Preserving National Sovereignty).
The thesis, by student Hala Jassim Al-Ameri, clarified the identification of modern features of national sovereignty and sovereignty based on its historical development.
She pointed to the rules for the formation of the Federal Supreme Court and its role in preserving national sovereignty.
The researcher divided her thesis into two chapters, the first devoted to the principle of national sovereignty and the challenges it faces, and the second dealt with the position of the constitutional judiciary on national sovereignty.
The researcher suggested expanding the jurisdiction of the Federal Supreme Court on reviewing international treaties and conventions before voting on them to ensure that national sovereignty is not violated and setting legal standards that determine how to evaluate the constitutionality of international treaties and conventions.
She called on the Council of Representatives to legislate a law defining the framework of digital sovereignty in Iraq, including the state's rights to control digital data and information and protect digital infrastructures.
The researcher spoke about the importance of creating a competent body that works between the Federal Supreme Court on the one hand, and the legislative and executive authorities on the other, to follow up on the court's decisions issued under its interpretative jurisdiction and consider the constitutionality of laws, treaties and decisions of the executive authority.
The researcher concluded that practical steps should be taken to ensure the independence of the Federal Supreme Court from political and economic pressures within the framework of achieving the rule of law.
