Federal Supreme Court issues a new decision on Supreme Judicial Council law

      According to the Federal Supreme Court, the assumption of the general administrations of the Supreme Judicial Council by the holders of primary university degrees does not violate the principle of judicial independence.

 

"The Federal Supreme Court held its session under the chairmanship of Judge Medhat Al-Mahmoud and the presence of all its members and received an appeal against The Supreme Judicial Council Law No. (45) of 2017," the court said in a press release.

 

"The plaintiff stated in his lawsuit that the law had been introduced by the executive power, and objected to the assumption of the positions of the general administration of the Supreme Judicial Council and stressed that this violation of the principle of judicial independence had been mentioned in the Constitution," the statement said.

 

"The court confirmed that the Supreme Judicial Council law was part of several laws sent by the federal judiciary power and some of its provisions were amended," the statement said.

 

"The Federal Supreme Court addressed these amendments in an earlier decision by number (19/federal/2017)," he said.

"The court found that the assumption of the positions of the public administration of the Supreme Judicial Council by the holders of the initial university degrees does not lead to a violate the principle of judiciary independence, because the public administration specializes in the affairs of the personnel and does not mean the practice of the judiciary," the statement said, adding that "the court dismissed the case because it lacks the constitutional basis for it."
