Federal Supreme Court issues explanation of the Constitution amendment mechanisms

     The Federal Supreme Court issued an explanation regarding the mechanisms for amending the Constitution following articles (126) and (142) of it.

 

A statement issued by the court stated that it had "received a request for the extrapolation of articles (126) and (142) of the Constitution, which speaks of its amendment mechanisms, and issued a decisive and unanimous decision on two decisions in this concern".

 

"The court, after scrutiny and deliberation, found that article (142) of the Constitution has been initiated for circumstances that require the interest of the main components of the people in Iraqi society to be secured by amending the provisions of the constitution following the procedures and steps drawn in it," the statement said.

 

"These measures differ in some of their joints from those contained in the article (126) of the Constitution, taking into account considerations that Article 142 had been enacted to achieve," he said.

 

"Paragraph 5  of the article (142) of the Constitution provides for the exception of article 126 of this article on the amendment of the Constitution until the amendments stipulated in the provisions of the article (142) are finalized," the statement said.

 

" The statement stated that "the exception mentioned in article 5 (142) is a condition unless it is achieved and the provisions of article (126) of the Constitution cannot be applied and that constitutional provision must be observed."

 

The decision finds that "the implementation of the article (126) of the Constitution when submitting a proposal to amend one or more articles of the Constitution shall only be after deciding on the amendments recommended by the Committee provided for in paragraph (1st) of the article (142) of the Constitution following the procedures mentioned in this article."
