The Federal Supreme Court rules that Article (25 repeated) of the Law on the Sale and Rent of State Funds is unconstitutional

Today, Wednesday, 8/3/2023, the Federal Supreme Court considered constitutional lawsuit No. (17/Federal/2023) filed by the plaintiff, Representative Dr. Raed Hamdan Al-Maliki / member of the Parliamentary Legal Committee, against the defendant, the Speaker of the Council of Representatives / being in this capacity, to challenge the unconstitutionality of Article (25 bis) of the Law on the Sale and Rent of State Funds No. (21) of 2013, as amended, published in the Iraqi Gazette No. (4415) on 5/9/2016, which stated that (The Minister of Finance may sell or rent agricultural lands that are located outside the taboos of roads that cut off the water share without public auction, and the Minister of Agriculture shall lift the hand of agricultural reform from those lands, and the sale and rent allowances shall be recorded as final revenue for the State Treasury, provided that easement rights are taken into account), and decided to rule the unconstitutionality of the aforementioned article for violating the provisions of Articles (14 and 27 /1st) of the Constitution of the Republic of Iraq for the year 2005, a final and binding judgment for all authorities.
