The Federal Supreme Court rules that powers granted by the Constitution may only be authorized by a constitutional provision

     The Federal Supreme Court rules that the necessity of legal text which allows authorization must have the same legal rank as the text prescribed for jurisdiction or higher than it is legal rank.

According to the judgment issued by it No. (235/Federal/2022), it ruled that Diwani Order No. (469) of 2022 was formally invalid, as it was issued with the signature of the head of the legal department and the Secretary-General of the Council of Ministers without a legal text that includes the permissibility of delegating authority or signing to the head of the legal department.
