Federal Supreme Court: Working in NGOs and unions does not conflict with the membership of a deputy in the Council of Representatives

        The Federal Supreme Court issued its interpretative decision No. 171 / Federal / 2023 on 21/9/2023, which relates to the interpretation of Article (49/4th) of the Constitution of the Republic of Iraq for the year 2005, which stipulated that (it is not permissible to combine membership of the Council of Representatives, any work, or any other official position).

The court's correspondent explained that the interpretation of the aforementioned article under the court's interpretative decision is clear that: The deputy may not undertake any official work, and this work does not include other work that does not acquire official status, including work in non-governmental organizations, unions or others, unless the competent authority decides to restrict or limit work in other informal work under or based on a law, provided that this restriction or limitation does not affect The essence of the right to work based on the text of Article (46) of the Constitution in order to prevent influencing the Representative when exercising his parliamentary duties, and enable him to devote himself to his duties and consolidate his role in this field to maintain the prestige of the Council of Representatives, which means that working in non-governmental organizations and unions does not conflict with the membership of the Representative in the Council of Representatives.
