Participation of the Federal Supreme Court in the Conference of Constitutional Courts in the Islamic World/Türkiye

The Federal Supreme Court participated in the “Conference on Constitutional Courts in the Islamic World,” which was held remotely (via Zoom) on Wednesday, January 17, 2024. The court was represented by Dr. Judge Haider Ali Nouri, a member of the Federal Supreme Court, and the goal of the conference was to Rapprochement and draw up prospects for future cooperation. The conference was opened by Mr. Dr. Murat Şen, Secretary General of the Turkish Constitutional Court, and he introduced the representatives of the countries participating in the conference, namely (Iraq, Azerbaijan, Yemen, Cameroon, Uzbekistan, Tajikistan, and Somalia).

The conference agenda was discussed reports containing the activities of the year 2023 were presented, and the request for inclusion in the statute of the World Conference on Constitutional Justice under the list of regional and linguistic groups was unanimously approved, and the topic of the hosting country for the next meeting in the next presidential session was discussed, and the topic of activities planned for the year 2024 was discussed.

The first paragraphs of the Federal Supreme Court’s participation in the conference are divided into two paragraphs:

The first included the brief welcome speech delivered by a member of the Federal Supreme Court, Dr. Judge Haider Ali Nouri, representing the court, which stated: ((I am pleased to be among you and take this opportunity to convey the greetings of His Excellency the President of the Federal Supreme Court, Judge Jassem Muhammad Abboud, wishing your conference success and prosperity. Thank you)).

The second paragraph included a detailed and introductory speech in which Dr. Judge Haider Ali Nouri discussed the details of the court the specificity of its decisions and its independence. Some of them are as follows:

((May God’s peace, mercy, and blessings be upon you. The participation of the Federal Supreme Court in the First Conference of Constitutional Courts in the Islamic World was a bright spot for the constitutional judiciary in Iraq, which is represented by the Federal Supreme Court. The Federal Court in Iraq is supportive of the Conference of Constitutional Courts in the Islamic World, and is pleased This court should communicate with the constitutional courts in the world and benefit from the experiences of the constitutional courts in the Islamic world and other countries, at the level of the constitutional judiciary in Iraq that supports the basic and main principles of protecting rights and freedoms and achieving the state of law and the state of institutions).

We also affirm to all constitutional courts in the Islamic world that the Federal Supreme Court in Iraq is an independent judicial body and court, and that this independence is from the legislative and executive authorities in Iraq, and it is also independent of the ordinary judiciary and the administrative judiciary, and thus the Iraqi constitutional experience led by the Federal Supreme Court In Iraq, it represents a pioneering and important experience that can be benefited from at the level of constitutional courts in the Islamic world. The independence of the Federal Court in Iraq was a result of the provisions of the Constitution of the Republic of Iraq for the year 2005 and the complete independence of its judges represented by the President and all members of the court from any political orientation. This independence was reflected positively. On the work of the court, and thus all authorities in the state, including the legislative and executive authorities, have become subject in all their work to the oversight of the Federal Supreme Court, to guarantee rights and freedoms in an effort to confirm the existence of a state of institutions and respect for the provisions of the Constitution, and that the Federal Supreme Court is in the process of building and constructing a edifice worthy of its constitutional status. Iraq and the countries of the Islamic world, it is ready to host the conference once that edifice is completed. The court reaffirms its support for the conference of the Union of Islamic Constitutional Courts and its support for the Islamic constitutional courts through communication and exchange of experiences.
